tax help This is not for me but I am doing a c/p of someones post that is looking for answers.

as some of you know i wasn't pleased to find out i paid $5000 in daycare and only get $15 back.
ok little bit to get you started lol. most know that "dh" and i aren't married. well i let him claim the kids on taxes because until next year NYS takes my refund for my school loan. i paid a creditor for 9 months this year and then it was put back in good standing with the student loan company and taken off my credit report as bad and i make monthly payments to them....anyway....
can i claim the daycare cost on mine if he claims the kids. i paid all the daycare. it would kinda be like someone else paying right?? i've looked online but can't seem to come up with anything. anyone know?

Not to be a stick in the mud here but isn't that almost or kinda illegal? Allowing someone else to claim your kids so the gov. doesn't get your money? Then look for a way to recoup your own childcare costs? Doesn't seem on the up an up to me.

I don't know. but I thought the father can claim his kids and if you are both taking care of them then can you both claim them? And they are asking if it can be done not trying to do anything illegal.
Just like me and my son at one time he worked he filed his taxes and on there it says can someone else claim you? We said yes and then I claimed him also because I took care of him 50% or of the time.

But she clearly stated she was allowing him to claim the kids so the government didn't take her money. It wasn't because she was being fair yadda yadda yadda. She is trying to find a loop hole where she can get the biggest bang for her buck without the responsibilty of paying her debt. But thats just the way I see it. And trust me, I am a total idiot when it comes to tax time, thank God for CPAs.

She is paying her debt.And I guess we all try to get the biggest bang for our buck. I know at tax time I do.Thats why I have my cpa find me all he can. And she is making payments on here own now she said. And evan if they were keeping her income if this gives her more bang then they would get it anyway.
It wasn't that they couldn't get it they could but her if she filed with her kids then her refund would of been more and they would of got that also. At least that is what I think she meant.

Like I said I don't know much, actually less then that. I shouldn't have said anything...lol. Anyways, hopefully there is someone here smarter than me. If not, we are all sunk...lol.

I answered this in the money forum at MWT. I don't know if I understood the relationship between the mother and father though. If the mother has primary custody she can allow the father to claim the kids (and vice versa.) If they are living together but not married either parent can claim the kids. As long as it's one of the parents (assuming they are financially supporting the kids) claiming the kids and it's ok with the other parent it's ok to do it.

Children can only be claimed by one parent. Even know you paid daycare, you could try and claim that on your taxes. But I think it will be red flagged since you are not claiming the child. Best bet I think is to let"dh" claim the expense and the child.

Claiming daycare expenses and claiming the child are 2 different things. It's not a red flag at all as a lot of noncustodial parents pay for their child's daycare.

ok so i am the question starter. i'll try to give back ground...
we live together, not married. he claims the kids. i owe for my student loan in NYS. I am making payments. They were doing wage garnishment and every year irs would take my refund but then got it worked out with creditor and paid them for 9 months. now my loan is back with the school and in good standing and off my bad credit and working toward good credit(yeah me). i have to be out of repayment with the creditor for a year (next october) before they will stop taking my refund.
I paid the daycare provider about $5000 this year to watch the kids so that we could work. I did his taxes and like i said he claims the kids and head of household. I entered the amount paid to the sitter and it added $15 to his refund.
My question was can I claim the paying of the daycare if i'm not claiming the children on my taxes? I haven't even gotten my W2 back yet so no biggie. I have discussed it with the sitter and if it's not possible we are just not even going to claim her on the taxes. might as well help her out. she will probably benefit more from not having to pay taxes on $5000 then we will to claim it. sorry to have caused so much confusion. i should have just asked it myself.
